Agreements
This agreement governs your use of the Parking Enforcement Center Web site and
IVR Systems and services we provide (collectively, the "Agreement"). By using
our site, you are consenting to the below terms. The Parking Enforcement Center
Web site is intended for U.S. users only. If you access the Parking Enforcement
Center Web site usage from any non-U.S. territory, you do so at your own risk
and you are responsible for compliance with any local laws.
Definitions
In this Agreement, "you" and "your" refer to the web user. The words "we,"
"our," and "us" refer to, Parking Enforcement Center. "Account" refers to the
bank account or the credit card or debit card account you designate as the
payment account for the Service Center (as described below). "Bank" refers to
Financial Institution or card issuer, which holds or issues your Account.
"Agreement" refers to the terms and conditions stated below
Description
The Service Center is Interactive Voice Response System and or web based -
Internet service that allows you to make payments of amounts you owe on your
parking ticker to the agency. By using your debit or credit card over the
Internet or Voice Response unit you will be processed through the Visa Center.
(Collectively, the "EZ Pay Corp, Money Transmission Vendors") to provide money
transmission services as part of our provision of the Service Center. You
authorize Parking Enforcement Center to instruct one or more of the Parking
Enforcement Center Money Transmission Vendors to debit your account and forward
your payment per instructions you provide on the Web site, subject to the terms
of this Agreement. You agree to use the Service Center only lawful purposes.
Using our Service Center
You must complete all requested information. If you are concerned about your
privacy, please read our privacy policy. Your Account may be a credit card or
debit card account or a checking account. You authorize Parking Enforcement
Center to instruct it's vendors to initiate debit entries to your account or to
initiate credit card or debit card transactions, as applicable, in the amounts
you specify on the Web site, and to initiate any debit or credit entries or
reversals, as the case may be, to your Account as may be necessary to correct
any error in a payment or transfer. You also authorize Parking Enforcement
Center to instruct one or more of the Parking Enforcement Centers to debit or
charge your Account for all Parking Enforcement Centers convenience fees and
other amounts, which are due under this Agreement. Your Account will show
separate transactions for the payment to your agency and for our convenience
fee. Once you complete a transaction on the Web site, your authorization to
Parking Enforcement Center to debit or charge your Account shall remain in full
force and effect until the transaction is final, including any reversals or
charge backs by a card association, card issuer, or your Financial Institution
or other clearing house member, as the case may be, which may occur in the
future. In order to make the payments, we will transfer your funds to the Payee
you designate by electronic transfer or by mailed check, at our discretion.
Transfers to Payees generally will be made within three Business Days from the
Business Day on which the transaction is authorized by you on our Web site if by
electronic means and within five Business Days from the Business Day on which
the transaction is authorized by you made if by mailed check. If you use the
Service Center to make a transaction on a day other than a Business Day, or
after 5 P.M. Eastern Standard Time on a Business Day, your transaction will be
deemed authorized on the next upcoming Business Day.
Intended Use
You must be of legal age to use the Service Center. Payments are limited to
domestic (U.S.) Accounts and Payees and must be made in U.S. dollars. You agree
not to use the Service Center in an amount that will exceed the funds or
available credit line in your Account. If you do, we have no obligation to
complete the transaction and you agree that we may debit your Account for our
returned item or other similar fee. Other limitations on the Service Center may
apply and can be found on the Web site. Your use of your Account may be limited
by your agreement with your Bank and by applicable law. We are not responsible
for not completing a transaction as a result of any such limit on your Account,
and we are not responsible if your Financial Institution fails to honor any
debit against your Account. At our sole discretion, we may refuse to complete
any transaction, which we have reason to believe is not made by you, may violate
any law, and rule or regulation, or if we have reasonable cause not to honor it.
Incomplete Transactions
If a transaction you initiate cannot be completed because your Account cannot be
debited as you authorized, then the transaction is considered voided and no
further action will be taken.
You may cancel a transaction by calling our customer service unit only on the
same day you have made the transaction. You may not cancel a transaction after
the day on which it is authorized.
In Case of Errors Questions
Questions about payments made through the Service Center can be directed to
Parking Enforcement Center by calling the toll-free number that appears on our
site or by sending us an email at support@EZPayCorp.com. You agree to call or
email us as soon as possible, but no longer than 3 days after you knew or should
have known about any error by you, if you believe an error has been made or
there has been any unauthorized use of your Account. When you contact us, please
be prepared to provide your name, your transaction reference number and your
Account number.
Verification
You agree that all disclosures and communications regarding this Agreement and
the Payment Service may be made electronically on the Web site or telephone. Any
electronic disclosure or communication we make will be considered made when it
is posted to the Web site. You acknowledge we will not send you any statements
detailing the transactions that you make using the Service Center. You may print
a copy of the transaction verification screen for future reference. The
Financial Institution holding your Account will maintain a record of
transactions against your Account. You agree to promptly review and verify the
record of your transactions on your Account when you receive the Account
statement from your Financial Institution.
Fees
You agree to pay the convenience fees for the Service Center, which are
disclosed on the Web site. This fee will be deducted from the transaction amount
and the original fine amount will be forwarded to you while our fees will be
held back in our account. Our fees may change from time to time.
Privacy
Parking Enforcement Centerwill not sell or make available to any third party any
information that identifies you, your account or payments you make through our
service center, other than to complying with laws or regulation. Be acknowledged
that Parking Enforcement Center will receive certain information about you when
you use our payment center to process your payment
Waiver of Warranties and Damages
EZ Pay Corp. disclaims, for itself and its vendors, all warranties, either
express or implied or statutory, including, but not limited to, any implied
warranties of merchantability or fitness for a particular purpose. In no event
shall Parking Enforcement Center or any of its vendors be liable for (a) errors
caused by you, including but not limited to, incorrect or incomplete Payee or
Account information, or (b) any damages other than those caused by the gross
negligence or willful misconduct of Parking Enforcement Center, provided that in
no event will Parking Enforcement Center be liable to you for any indirect,
special, incidental or consequential damages including, but not limited to,
damages for lost profits, disclosure of confidential information, or loss of
privacy, arising out of or in any way related to the use of or the inability to
use the Service Center. This Agreement does not create any contractual
relationship of any kind between any Parking Enforcement Center vendor and you.
Accordingly, in no event will any Parking Enforcement Center vendor be liable to
you under any circumstances with respect to the Service Center. In addition, in
no event will Parking Enforcement Center be liable for any act or omission of
any third party including, but not limited to, a Payee, your Financial
Institution, any payment system, or any provider of telecommunications services,
Internet access or computer equipment or software or for any circumstances
beyond its control including, but not limited to, fire, flood or other natural
disaster, war, riot, strike, act of civil or military authority, equipment
failure, computer virus, or failure or interruption of electrical,
telecommunications or other utility services. We are not liable for delays
caused by the mails or any payment or clearinghouse system. We are not liable
for the failure of a Payee to provide timely credit for your payment or for any
act or omission of any Payee. We are not an agent of the Payee and have no
control over the Payee's procedures for crediting payments.
Termination
Parking Enforcement Center may suspend or terminate your use of the Web site at
any time, without notice for any reason. Except as warranted by risk to the
security, privacy or integrity of the Web site and the payments processed by us,
we will attempt to provide you with prior notice of the suspension or
termination by sending you an email, but we are not obligated to do so. You
shall remain liable for all transactions you initiated through the Service
Center, and the payment of all amounts you owe prior to termination or
discontinuation of your use of the Service Center. You agree to pay all costs
and expenses that Parking Enforcement Center may incur in order to collect any
amounts you owe under this Agreement.
Assignment
Parking Enforcement Center may assign the Agreement to any current or future,
directly or indirectly, affiliated company and to any successor of Parking
Enforcement Center. Parking Enforcement Center also may delegate certain of its
rights and responsibilities under the Agreement to independent contractors or
other third parties.
Miscellaneous
This Agreement constitutes the full agreement between you and us related to the
use of this Web site. If any provision of this Agreement is held invalid or
unenforceable, all other provisions will remain in full force and effect. We may
choose not to exercise or to delay enforcement of any of our rights under this
Agreement without losing them. Use of the Web site will constitute your
signature to this agreement and evidence that you have read, understand, accept
and agree to the terms of the Agreement. You may print a copy of this Agreement
for your records.
Amendments
The terms of this Agreement may be amended by Parking Enforcement Center from
time to time. In such event, EZ Pay Corp. will post the amended terms on our
site. If you use our Web site after we post such a change on our Web site, it
will constitute your agreement to the revised terms. You may terminate this
Agreement by not using the Web site if you do not agree with any such amendment
Governing Law
THIS AGREEMENT SHALL BE GOVERNED IN ACCORDANCE WITH THE LAWS OF THE STATE OF
MICHIGAN.
